-My husband received a phone call at his job today from a company called "CAPITAL" phone number 888-858-2019 they said he owed a debut and threatened to sue him tomorrow. I called to find out what this was in regards to and the lady I spoke with said she was the fraud supervisor of the company and that she was filling paperwork first thing tomorrow morning with the courts to sue my husband for a debut of $300 for a loan 2 years and if he didn鈥檛 appear in court he would receive a failure to appear warrant.
2 years ago my husband and I fell on some hard times and went to check in the cash for a payday loan of $150 dollars, we were approved, received the money, paid it back, and that was it. Weeks later my husband received a called from some unknown loan company saying he was approved for the loan he applied for. He assumed I had applied for a loan and forgot to tell him, the company proceed asking him questions and being that he was busy and distracted at work he provided the answers they were seeking like his work info, social security number and other personal info. When he got home and asked me about it I told him I never applied for any loans, we research the company name they provided him and realized it was a company with several complaint of fraud so I called the bank to notify them immediately in hopes to avoid any future problems.
We noticed that there was a suspicious credit of $300 dollars in our bank account at Bank of America. I contacted the bank spoke to a supervisor and was told that the $300 dollars was from some loan company. I informed them we had not applied for any loans and that we didn't want the money so they said they would take care of it and our next bank statement reflected that the money was no longer in our account it said something like reversed transaction.
About a month or so later we notice there was a withdraw from our account in the amount of $300 and I called the bank to find out what was going on since it had left our account overdrawn. After speaking to numerous representatives and a few supervisors I finally got a hold of someone who resolved the issue and credited back our money and said they were filling a fraud report on the money and we would receive a letter affidavit from the bank, we needed to fill it out and send it back and we did. Bank of America also blocked the loan company from making any kind of future activity on our account, even closed the current accounts and reopened a new one鈥檚. That was the end of that, or so we thought until today when this company called my husband at work. I don't know what to do; we don't want to be sued for a debut we don't owe. What should we do? Has anyone heard of or dealt with this company? And is it legit? I tried google and other business look up sites and have had no luck any advice would be a huge help.... THANKSIt may or may not be a legitimate debt. They are LYING about suing him tomorrow. If they planed to sue anytime in the near future, they would inform you by actually serving you with a lawsuit. You can tell a collector is lying because their mouth is moving.This sounds like a scam. Call the company and tell the person to send you all the documentation proving that you owe the money by certified mail. By the way, the word is debt, not debut.
If it is a real debt they have to send notice within 10 days. When he receives notice in writing then you can determine if it's a valid debt. Know your right, wwwnfcc.org
1. Close your Bank of America account right now
2. Open an account at a LOCAL bank or credit union and start banking there.
3. Tell "Capital" to go pound sand or produce signed documentation regarding this so-called loan IN WRITING.
First ask them to send you paperwork about what company they represent. Find out what company they represent and then call a local branch and have them check your account with them.
If the guy calling you has a middle eastern accent and threating you with jail or will not send you the paper work then it is fraud.
Absoloutley no civil action will EVER result in a arrest, so their warrant threat was bull. It's a collection agency so they're not going to sue you, they're going to tank your credit though. The payday loan company sold your debt to this agency and they are trying to recoup their losses and make a profit. Some woman who goes home everynight telling her plants and cats how tough she is, starting talking to your husband and talking big. Search online for a sample letter of validation, not verification but validation. According to the FDCPA if they respond with an invoice from the collection aganecy you will own that company, as soon as they get that letter any and all phone communication will cease.
