-I have a loan, in which my father is the cosigner, and since im not being able to pay it, im considering filing for bankruptcy, how can that affect my father? if it does, in what way?Your father will remain liable on the debt. As cosigner, your father promised to pay the loan if you did not; your bankruptcy does not affect this agreement.
However, if you file a Chapter 13 bankruptcy, and pay the loan through the Chapter 13 Plan, the lender will not be able to go after your father.
The co-signer on the loan has agreed to be held fully responsible for the principal and interest of the loan if the borrower does not pay for any reason.
