-I currently have almost $100K in cc debt, and the minimum payments are over $3000/mo. This hardly pays any of the balance, and I am feeling they will never get paid off. Now I am running into not having enough money a month to make my mortgage...something needs to give. Can I declare bankruptcy on these cards, or will the creditors come after my home or rental properties? I really need an answer soon before I end up losing everything. I live in Colorado. When you file bankruptcy, you are declaring that you, the human being, is bankrupt. With very few exceptions, all of your assets are at risk. You may get to keep the home in which you live. You will almost definitely lose the rental properties.
